What is Delta-8

Delta-8 and delta-9 are both forms of THC. Normally, when people refer to THC they are talking about delta-9 THC. (See information below for information about delta 9.)

Legal concerns about delta are a little confusing.. It can be extracted from either hemp or cannabis. Because of the 2018 farm bill, hemp can be legally grown and used for extractions all over the United States, making delta-8 legal in states where delta-9 THC is illegal. 

People in states where THC is illegal crave cannabis products and are now looking to delta-8 because it may be legal in their state, even though it is less potent than regular THC. Many extractors are ramping up delta-8 production to meet this new demand and shipping it all over the US. 

 

What’s the difference between Delta-8 & Delta-9 THC?

Delta-8, like delta-9 (regular THC), causes you to feel high. Chemically, delta-8 and delta-9 are similar in that they both affect you chemically. Delta-8 produces the intoxicating effects that make you feel high. The two THCs are chemically different. Delta-8 is much less potent than regular THC. However, research is ongoing on exactly how it affects the body.

 

Am I going to get high using delta-8 ?

You can get high, but it’s a much different high than delta-9 THC. Many people are choosing delta-8 to experience a similar high in places where THC is illegal.Some even prefer cannabis products that aren’t as strong as common. Delta-8 may offer a smoother, milder high instead of the anxiety and paranoia that THC is likely to produce. If you are looking for effects similar to THC but with a reduced potency, delta-8 may be for you. If you seek relief from certain symptoms and don’t want to get intoxicated, you may want to try a CBD product

Effects of delta-8

Many people who use Delta-8 indicate that they have similar effects as they had with delta-9., These include mild euphoria, happiness, uplifting feelings, and relief from some symptoms such as pain, although the compound is much less potent. Delta-8 can also help with insomnia.Side effects may be similar to those of THC, including dry mouth, red eyes, getting the munchies, short-term memory, paranoia, or anxiety. There is still a lot of information to gather and research is ongoing..

As with any substance, try a little first and see how your body reacts. You’ll know how quickly it affects you and how long it lasts. Wait a little before taking too much. Then increase as desired. 

 

Is delta-8 legal?

The jury is still out. Not many states deal with Delta-8 laws right now. They only cover marijuana. There are 11 states rights currently where delta-8 is illegal (see below for list of states). Keep in mind that delta-8 is a derivative of hemp wich is a derivative of CBD and federally legal!

Legal

The status of Delta-8 THC under federal law is not clear, due to a conflict between the law and a Drug Enforcement Administration (“DEA”) regulation. Under the federal 2018 Farm Bill, all hemp-derived cannabinoids, including all Delta-8 THC derived from hemp, fall within the definition of “hemp,” which is no longer a controlled substance federally, and can be legally produced and sold, subject to a complex set of federal regulations. However, in Fall 2020 the DEA issued an “Interim Final Rule” which stated that “[all] synthetically derived tetrahydrocannabinols remain schedule 1 controlled substances.” The Biden Administration has indicated that it will permit the Final Rule to go into effect later this month.

Hence the confusion: Delta-8 THC, when manufactured from hemp-derived CBD (and thus not extracted directly from the hemp plant), is a controlled substance under federal law. Until this uncertainty is addressed by Congress, the DEA or the courts, there is some risk that Delta-8 THC remains an illegal “controlled substance” under federal law, despite the hemp-derived CBD from which it is manufactured being legal at the federal level.

Products containing Delta-8 THC do not appear to be prohibited by FDA regulations, but still must receive pre-market approval. Under the 2018 Farm Bill, the FDA retains authority to regulate products that contain cannabis or cannabis derivatives under the federal Food, Drug and Cosmetic Act (FDCA). The FDA has also promulgated its Drug Exclusion Rule, which states that any substance that has been approved or investigated by the FDA as a new drug cannot also be marketed as a food or dietary supplement for humans or animals, unless the substance was sold and marketed prior to the FDA’s investigation. It is this Drug Exclusion Rule that causes the sale of products containing CBD to be of questionable legality under federal law. There do not appear to be any FDA investigations regarding Delta-8 THC, so it appears that the Drug Exclusion Rule does not apply to the sale of products that contain Delta-8 THC.
